ECSPR at Three Years: The European Single Market for Crowdfunding Still Under Construction

On July 7, three years have passed since the entry into force of the EU Crowdfunding Service Providers Regulation (ECSPR). Although a single regulatory framework exists in law, the market reality still shows a Europe of regulatory fragmentation. According to analysis published by Eurocrowd, fourteen different national regimes still coexist, hindering true cross-border interoperability.

The ambition of ECSPR was to create a European passport that would allow platforms to operate across the Union with a single authorization. However, implementation has been uneven. Some member states have developed complementary frameworks that, far from facilitating harmonization, add layers of complexity. This translates into higher compliance costs for platforms and, ultimately, less diversified supply for retail investors.

The report notes that the lack of a full passport remains the main bottleneck. Platforms wishing to operate in multiple jurisdictions face bureaucratic obstacles that curb the scalability of the pan-European crowdfunding model. Although the regulation has laid the groundwork, the single market remains a work in progress.

For European investors, this fragmentation means that geographic diversification opportunities remain limited by invisible regulatory barriers. Transparency and consumer protection are tangible advances, but the sector’s growth potential will not fully unfold until coordination among national supervisors and convergence of requirements become a real political priority.
